Article 2 – Purpose and Scope

These Terms and Conditions of Sale (hereinafter "T&Cs") apply, without restriction or reservation, to all purchases of products made by any customer (hereinafter "Customer") on the website www.byhooma.com (hereinafter "the Site"), operated by HOOMA LLC.

By placing an order on the Site, the Customer acknowledges having read and accepted these T&Cs in their entirety. HOOMA reserves the right to modify these T&Cs at any time. The T&Cs applicable to any order are those in force at the date the order is placed.


Article 3 – Products

HOOMA is a premium home and lifestyle brand offering a curated range of design products including furniture, home décor, and lifestyle accessories. Products are presented with their key characteristics, availability status, and prices including applicable taxes. HOOMA reserves the right to modify its product catalog at any time without prior notice.


Article 4 – Pricing

All prices displayed on the Site are shown in US Dollars (USD) and are inclusive of applicable federal and state taxes where required by law. Prices do not include shipping fees, which are calculated separately based on the order weight, dimensions, and delivery destination.

HOOMA reserves the right to change its prices at any time. Products are billed at the price in effect at the time the order is confirmed. Promotional prices are valid only for the duration stated on the Site.


Article 5 – Orders

5.1 Order Process — To place an order, the Customer selects the desired products, creates an account or logs in, provides shipping and billing information, selects a delivery method, and proceeds to payment. A confirmation email is sent upon receipt of the order, at which point the sales contract is deemed concluded.

5.2 Product Availability — All offers are valid while supplies last. If a product becomes unavailable after an order has been placed, the Customer will be notified within 48 hours and offered either an equivalent substitute product or a full refund.

5.3 Order Modification and Cancellation — Any request to modify or cancel an order must be submitted to our customer service team at byhooma@thesupportcare.com within 2 hours of placing the order. After this period, HOOMA cannot guarantee that the request will be accommodated.


Article 6 – Payment

Payment may be made by credit or debit card (Visa, Mastercard, American Express) via SSL-secured payment, or by bank transfer. Full payment is due at the time the order is placed. Title to the products passes to the Customer only upon receipt of full payment.

HOOMA uses industry-standard encryption technology to protect the Customer's payment information. HOOMA does not store full credit card details on its servers.


Article 7 – Shipping and Delivery

7.1 Delivery Zones — HOOMA ships to all 50 US states and US territories.

7.2 Estimated Delivery Times — Continental US: 5 to 7 business days. Alaska and Hawaii: 7 to 10 business days. These timeframes begin from the shipping confirmation date and are provided as estimates only. HOOMA ships exclusively via DHL to ensure reliable, fully tracked delivery.

7.3 Receipt and Inspection — Upon receipt, the Customer must inspect the package and its contents. Any damage or missing items must be reported to the carrier and notified to HOOMA at byhooma@thesupportcare.com within 72 hours of delivery.

7.4 Delays — In the event of a delivery delay exceeding 30 days from the confirmed shipping date, the Customer may cancel the order and receive a full refund.


Article 8 – Returns and Right of Withdrawal

HOOMA offers a 30-day money-back guarantee from the date of delivery. If the Customer is not satisfied with their purchase for any reason, they may return the item(s) within 30 days for a full refund.

To initiate a return, the Customer must contact byhooma@thesupportcare.com. Products must be returned in their original condition, unused, with all original packaging, tags, and accessories included. Return shipping costs are the responsibility of the Customer unless the return is due to an error by HOOMA or a defective product.

Refunds are processed within 10 business days of receiving the returned item, using the same payment method as the original purchase.

The right of return does not apply to: personalized or custom-made items, perishable goods, digital products or software once downloaded or activated, and hazardous materials.


Article 9 – Warranties

9.1 Statutory Warranty — HOOMA warrants that all products sold on the Site conform to their descriptions and are free from defects at the time of delivery, in accordance with applicable US consumer protection laws.

9.2 Manufacturer's Warranty — All HOOMA products are covered by a manufacturer's warranty. Customers may reach out to byhooma@thesupportcare.com for warranty assistance.

9.3 Defective Products — If a product is received damaged or defective, the Customer must notify HOOMA within 72 hours of delivery. HOOMA will arrange for a replacement or full refund at no cost to the Customer.


Article 10 – Limitation of Liability

HOOMA shall not be held liable for any indirect, incidental, special, or consequential damages arising from the use or misuse of products purchased on the Site. HOOMA's total liability in connection with any order shall not exceed the total amount paid by the Customer for that order. HOOMA shall not be held responsible for disruptions or outages affecting the Internet or third-party services.


Article 11 – Privacy and Data Protection

HOOMA collects and processes personal data in accordance with applicable US privacy laws, including the California Consumer Privacy Act (CCPA) where applicable. Data collected (name, address, email, phone number, purchase history, browsing data) is used for order processing, customer relationship management, and with consent, for marketing communications.

Customers have the right to access, correct, delete, or opt out of the sale of their personal data by contacting byhooma@thesupportcare.com. For California residents, additional rights apply under the CCPA.


Article 12 – Intellectual Property

All content on the Site (texts, images, logos, videos, graphics) is the exclusive property of HOOMA LLC and is protected by US and international intellectual property laws. Any reproduction or use without prior written authorization is strictly prohibited.


Article 13 – Dispute Resolution

In the event of a dispute, the Customer is encouraged to first contact HOOMA's customer service at byhooma@thesupportcare.com to seek an amicable resolution.

If no resolution is reached, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA), with proceedings conducted in Chicago, Illinois. Nothing in this clause prevents either party from seeking injunctive relief in a court of competent jurisdiction.


Article 14 – Governing Law

These T&Cs are governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Any legal action arising out of or relating to these T&Cs shall be brought exclusively in the courts of Cook County, Illinois.
