Article 2 – Purpose and Scope
These Terms and Conditions of Sale (hereinafter "T&Cs") apply, without restriction or reservation, to all purchases of products made by any customer (hereinafter "Customer") on the website www.byhooma.com (hereinafter "the Site"), operated by HOOMA LLC. By placing an order on the Site, the Customer acknowledges having read and accepted these T&Cs in their entirety. HOOMA reserves the right to modify these T&Cs at any time. The T&Cs applicable to any order are those in force at the date the order is placed.
Article 3 – Products
HOOMA is a premium home and lifestyle brand offering a curated range of design products including furniture, home décor, and lifestyle accessories. Products are presented with their key characteristics, availability status, and prices including applicable taxes. HOOMA reserves the right to modify its product catalog at any time without prior notice.
Article 4 – Pricing
All prices displayed on the Site are shown in US Dollars (USD) and are inclusive of applicable federal and state taxes where required by law. Prices do not include shipping fees, which are calculated separately at checkout. HOOMA reserves the right to change its prices at any time. Products are billed at the price in effect at the time the order is confirmed.
Article 5 – Orders
5.1 Order Process — To place an order, the Customer selects the desired products, creates an account or logs in, provides shipping and billing information, selects a delivery method, and proceeds to payment. A confirmation email is sent upon receipt of the order.
5.2 Product Availability — All offers are valid while supplies last. If a product becomes unavailable after an order has been placed, the Customer will be notified within 48 hours and offered either a substitute product or a full refund.
5.3 Order Modification and Cancellation — Any request to modify or cancel an order must be submitted to byhooma@thesupportcare.com within 2 hours of placing the order.
Article 6 – Payment
Payment may be made by credit or debit card (Visa, Mastercard, American Express) via SSL-secured payment. Full payment is due at the time the order is placed. HOOMA uses SSL/TLS 256-bit encryption and PCI DSS Level 1 certified gateways to protect payment information. HOOMA does not store full credit card details on its servers.
Article 7 – Shipping and Delivery
7.1 Delivery Zones — HOOMA ships to all 50 US states and US territories.
7.2 Estimated Delivery Times — Continental US: 5 to 7 business days. Alaska and Hawaii: 7 to 10 business days. HOOMA ships exclusively via DHL with full tracking on every order.
7.3 Receipt and Inspection — Any damage or missing items must be reported to byhooma@thesupportcare.com within 72 hours of delivery.
7.4 Delays — In the event of a delivery delay exceeding 30 days from the confirmed shipping date, the Customer may cancel the order and receive a full refund.
Article 8 – Returns and Right of Withdrawal
HOOMA offers a 30-day money-back guarantee from the date of delivery. If the Customer is not satisfied for any reason, they may return the item(s) within 30 days for a full refund. No questions asked. To initiate a return, contact byhooma@thesupportcare.com. Refunds are processed within 10 business days of receiving the returned item.
Article 9 – Warranties
HOOMA warrants that all products conform to their descriptions and are free from defects at the time of delivery. If a product is received damaged or defective, the Customer must notify HOOMA within 72 hours of delivery at byhooma@thesupportcare.com. HOOMA will arrange a replacement or full refund at no cost to the Customer.
Article 10 – Limitation of Liability
HOOMA shall not be held liable for any indirect, incidental, or consequential damages arising from the use of products purchased on the Site. HOOMA's total liability shall not exceed the total amount paid by the Customer for that order.
Article 11 – Privacy and Data Protection
HOOMA collects and processes personal data in accordance with applicable US privacy laws, including the California Consumer Privacy Act (CCPA). Data is used solely for order processing and customer relationship management. HOOMA will never sell or share your personal data. Contact byhooma@thesupportcare.com to exercise your rights.
Article 12 – Intellectual Property
All content on the Site (texts, images, logos, videos, graphics) is the exclusive property of HOOMA LLC and is protected by US and international intellectual property laws. Any reproduction without prior written authorization is strictly prohibited.
Article 13 – Dispute Resolution
In the event of a dispute, the Customer is encouraged to first contact byhooma@thesupportcare.com. If no resolution is reached, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Chicago, Illinois.
Article 14 – Governing Law
These T&Cs are governed by the laws of the State of Illinois, United States. Any legal action shall be brought exclusively in the courts of Cook County, Illinois.
